1. Purpose of the Agreement
www.hertz.org.az is owned by «S.A.LTD» LLC, registered in Azerbaijan with Tax Identification Number (INN): 1700142071, address: AZ 1025 Baku, Azerbaijan, 30 November 8th Avenue.
These General Terms and Conditions shall govern the contractual relationship between www.hertz.org.az and the customer (you). By making a booking on our website, you agree that the agreement for the use and provision of the service is concluded between you and our provider (the service supplier). You agree to abide by these Terms, as well as other information contained on the website.
By making a booking, you confirm that you have read these Terms and Conditions and have the legal capacity to accept them on your own behalf and on behalf of all passengers using the services.

2. Booking Process: Payment and Agreement
Bookings can be made online on our website. If a booking is made for two or more persons, the person making the booking ("the Lead Party") is deemed to have done so on behalf of all passengers and accepts these Terms on behalf of any passenger. The Lead Party must be at least 18 years of age.
Full payment is required at the time of booking. Upon receipt of full payment, hertz.org.az will process the booking and, upon confirmation, send the Customer the details of the services you have booked and a booking voucher. The voucher acts as a "ticket" and must be presented to the supplier's representative or driver.
Upon confirmation of the booking, a legally binding agreement will be concluded between the Lead Party and the supplier. No binding agreement is created until full payment is received.
hertz.org.az or its suppliers shall not be liable for the timeliness, accuracy, or quality of services due to incorrect information provided during the booking of the service. Prior to the trip, the customer is responsible for verifying the accuracy of all booking details and shall inform hertz.org.az in advance of any errors.
If any errors in the information provided by the Lead Party during the booking result in a change in the cost of the services, you shall be liable for this cost. In the event that you do not pay the difference due to incorrect information provided by you, hertz.org.az reserves the right to cancel the services without any compensation or refund of liability to you.
The supplier's price listed on our website is the final price, and no additional charges will be levied upon you if the information you provide during the booking is accurate.

3. SERVICES

3.1 Car Rental:

The vehicles displayed are examples; specific models within the same vehicle class may vary in availability and features.

Traffic violation fines: The Renter shall be liable for all types of traffic or road traffic violation fines incurred during the rental period. Traffic fines will be charged to the Renter in Azerbaijani Manat, and an additional service fee of up to 50 AZN may also be applied. The Renter agrees that Hertz may charge the Renter's credit card for the amount of traffic fines accrued during the rental period.

Fuel Policy: The vehicle is provided to the Renter with a full tank of fuel (4/4 units), and the Renter must return the vehicle again with a full tank. Otherwise, the missing unit(s) of fuel will be charged to the Renter.

Insurance: All insurance becomes invalid in the event of an accident if the necessary report (accident/police, medical/alcohol report, accident/insurance report) is not obtained immediately without moving the vehicle from the accident site. Insurance becomes invalid if the vehicle is operated under the influence of alcohol or drugs, or if it is driven in excess of the speed limit. In such cases, the driver will be held liable and responsible for all associated fines, vehicle damage, or the full value of the vehicle. Damage to windshields and tires not related to a reported accident is not covered.

Early Return: Please note that in case of returning the vehicle earlier than the specified period - no amount will be refunded.

3.1.1 Cancellation:

In case of order cancellation no later than 24 hours before the use of the first service -- the paid amount will be refunded minus 20 AZN.
In case of order cancellation less than 24 hours before the start of use of the first service -- the paid amount is refunded minus the rental cost for 1 day.

3.1.2 Amendments:

Changes to a booking may be made once free of charge no later than 24 hours before the use of the first service in a booking confirmed by us. Changes made by you must be made directly by sending an email from the email address you provided during booking to [email protected], specifying your booking number, the Lead Passenger's name, and the required changes. Amendments may result in additional costs, and you must pay these fees prior to any changes being made.
Changes cannot be made to a destination other than the one specified in your booking. Only additional services, pickup, and drop-off times may be changed.
In general and for most services, we do not charge a fee for amendments or changes to your booking, although we reserve the right to do so in case an amendment increases the cost of your original booking.

3.2 Transfers:
You are obliged to check the designated pickup time and ensure that you arrive at the airport, railway station, or port (or any other location) with sufficient time for check-in.
Meeting Point:
• If the pickup point is at the airport -- the driver will be standing with a sign bearing your name in the arrivals hall. The waiting time from the indicated pickup time is 1.5 hours. If you do not appear within this time -- the order is considered fulfilled and no amount will be refunded.
• If the pickup point is in Baku city -- the driver will wait at the specified address near the hotel reception desk or building entrance. The waiting time from the indicated pickup time is 30 minutes. If you do not appear within this time -- the order is considered fulfilled and no amount will be refunded.
• If the pickup point is in a region -- the driver will wait at the specified address near the hotel reception desk or building entrance. The waiting time from the indicated pickup time is 120 minutes. If you do not appear within this time -- the order is considered fulfilled and no amount will be refunded.

If you cannot find the driver, immediately call the relevant contact number. The phone number is indicated in the voucher sent to you upon order creation. If you arrange alternative transportation without notifying us, the supplier shall be released from its obligations to provide the service, and no amount will be refunded.
3.2.1 Minor Passengers
All children and infants, regardless of their age, will be counted in determining the vehicle's capacity and therefore must be included in the total number of passengers during booking.
3.2.2 Cancellation

3.2.2.1. For refundable payment:
In case of cancellation of a transfer from the airport to a region no later than 6 hours before the use of the service -- the paid amount is refunded in full.
In case of cancellation of a transfer from the airport to a region less than 6 hours before the use of the service -- the paid amount is refunded at a rate of 80%.

In case of cancellation of a transfer from Baku to a region no later than 6 hours before the use of the service -- the paid amount is refunded in full.
In case of cancellation of a transfer from Baku to a region less than 6 hours before the use of the service -- the paid amount is refunded at a rate of 80%.

In case of cancellation of a transfer from a region to Baku or the airport no later than 6 hours before the use of the service -- the paid amount is refunded at a rate of 80%.
In case of cancellation of a transfer from a region to Baku or the airport less than 6 hours before the use of the service -- the paid amount is not refunded.

In case of cancellation of a transfer from the airport to Baku or vice versa no later than 2 hours before the use of the service -- the paid amount is refunded in full.
In case of cancellation of a transfer from the airport to Baku or vice versa less than 2 hours before the use of the service -- the paid amount is not refunded.

3.2.2.2. For non-refundable amounts upon order cancellation, regardless of the number of hours before order execution, the paid amount is not subject to refund.

3.2.3 Amendments
Changes to a booking may be made once free of charge up to 12 hours before the use of the first service in a booking confirmed by us. Changes made by you must be made directly by sending an email from the email address you provided during booking to [email protected], specifying your booking number, the passenger's name, and the required changes. Amendments may result in additional costs, and you must pay these fees prior to any changes being made.
Changes cannot be made to a destination other than the one specified in your booking. Only additional services, pickup, and drop-off times may be changed.
In general and for most services, we do not charge a fee for amendments or changes to your booking, although we reserve the right to do so in case an amendment increases the cost of your original booking.

3.3 Chauffeur-Driven Rental:
The vehicles displayed are examples; specific models within the same vehicle class may vary in availability and features.
Car rental with a driver for a fixed term: the price will include an hourly limit. The driver will inform you when the limit is nearing expiration. In case of extension - a prepayment must be made via a special link indicated in your voucher, according to the hours you wish to extend the service.
In case the service is used for fewer hours than initially paid -- the amount will not be refunded.
The driver will wait for you at the hotel reception desk or building entrance.
If you cannot find the driver, immediately call the relevant contact number. The phone number is indicated on the transfer voucher.
3.3.1 Minor Passengers:
All children and infants, regardless of their age, will be counted in determining the vehicle's capacity and therefore must be included in the total number of passengers during booking.
3.3.2 Cancellation:

3.3.2.1. For refundable payment:
In case of cancellation of a car rental order for 1, 4, or 8 hours no later than 2 hours before the use of the service -- the paid amount will be refunded at a rate of 70%.
In case of cancellation of an order less than 2 hours before the use of the service -- no refund will be issued.

3.3.2.2. For non-refundable amounts upon order cancellation, regardless of the number of hours before order execution, the paid amount is not subject to refund.

3.3.3 Amendments
Changes to a booking may be made once free of charge no later than 4 hours before the use of the first service in a booking confirmed by us. Changes made by you must be made directly by sending an email from the email address you provided during booking to [email protected], specifying your booking number, the Lead Passenger's name, and the required changes. Amendments may result in additional costs, and you must pay these fees prior to any changes being made.
Changes cannot be made to a destination other than the one specified in your booking. Only additional services, pickup, and drop-off times may be changed.

3.4 Tours:
You will be shown a vehicle (cars) with 1 seat less than the normal capacity of the vehicle (cars) due to 1 guide accompanying the tour. The guide will wait for you at the hotel reception desk or building entrance. If you cannot find the guide, immediately call the relevant contact person. The phone number is indicated on the electronic voucher.
3.4.1 Minor Passengers
All children and infants, regardless of their age, will be counted in determining the vehicle's capacity and therefore must be included in the total number of passengers during booking.
3.4.2 Cancellation.

3.4.2.1. For refundable payment:
In case of order cancellation no later than 6 hours before the use of the service -- the paid amount will be refunded at a rate of 80%.
In case of order cancellation less than 6 hours before the use of the service -- no refund will be issued.

3.4.2.2. For non-refundable amounts upon order cancellation, regardless of the number of hours before order execution, the paid amount is not subject to refund.

3.4.3 Amendments
Changes to a booking may be made once free of charge no later than 5 hours before the use of the first service in a booking confirmed by us. Changes made by you must be made directly by sending an email from the email address you provided during booking to [email protected], specifying your booking number, the Lead Passenger's name, and the required changes. Amendments may result in additional costs, and you must pay these fees prior to any changes being made.

4. Cancellation by Us
In exceptional circumstances where hertz.org.az is forced to make significant changes to the terms of service or cancel a service, we will make reasonable efforts to find suitable alternatives for any confirmed booking we must cancel. If we are ultimately forced to cancel your booking, you will be refunded the full booking amount.

5. Booked Vehicles
We endeavor to respect our customers' preferences regarding the chosen vehicle; however, the vehicle may be replaced by one or more vehicles of greater capacity depending on availability. If the change constitutes a downgrade in the category or size of the vehicle for which we have a cheaper rate, the price difference will be refunded.

6. Luggage
Vehicles used for private transfers accommodate at least 1 medium-sized suitcase per passenger seat. During booking, you must inform us of the luggage to be transported. Small luggage items such as cameras, handbags, or small backpacks need not be declared. The passenger is responsible for any costs incurred if additional vehicles are required to transport undeclared luggage. Unless you are traveling with a guide dog, animals are not permitted.

7. Your Responsibility
By entering into this agreement, you represent that:
7.1 You are over 18 years of age and in full possession of your mental faculties, and therefore you are entitled to assume the legal obligations arising from this agreement, and that you are informed about the services subject to this contract, the company information, and the content of these General Terms and Conditions.
7.2 You represent that the credit or debit cards used for booking belong to you and that they have sufficient funds to cover the total booking amount.
7.3 You understand that you must notify us of any changes to the data provided by you as soon as possible.
Services will be provided in accordance with the information you provided, which was sent to you by email. You are responsible for providing complete and correct instructions for pickup and destination points during booking. It is also your responsibility to print and verify the accuracy of the voucher data. If the information contained in the voucher is incorrect, you must immediately contact our customer service for correction.
We are not liable for bookings that cannot be fulfilled due to insufficient or erroneous information provided by you, and no refunds are issued for such bookings.
In the event that hertz.org.az is forced to pay a deposit or fine to the country's authorities due to the customer's non-compliance with the laws, regulations, or other requirements of the country of Azerbaijan, the customer assumes full responsibility for reimbursing hertz.org.az. You hereby authorize us to charge your credit or debit card for any fine or damage incurred by the transfer vehicle (including, but not limited to, special cleaning), or any items missing from our supplier's vehicle.
We reserve the right not to accept further bookings from a customer who has repeatedly caused a major incident or incidents.

8. Our Liability
In the event of a breach of these terms, we shall only be liable for those damages or losses which are a foreseeable consequence of our failure to perform our obligations or our negligence, and no more than the total amount paid by you. We are not liable for damages that are not directly related to us or are caused by an accident, force majeure, or are caused by legal or administrative requirements.
We cannot be held liable if the performance of our obligations or those of the carrier is directly or indirectly impeded or affected by force majeure or any circumstances beyond our control, including, but not limited to, instances such as extreme weather events, natural disasters, terrorism, third-party accidents along the transport route, police controls, extreme traffic congestion, or strikes.
We are not liable for incidents that occur during the provision of the service, particularly for illness, bodily injury, or death, unless they are a direct result of our negligence.
This means that under these terms, we may assume liability if, for example, a passenger dies or sustains bodily injury, or if the transfer service is not provided in accordance with the contract or is performed improperly as a result of the incompetence or failure of our employees or the failure of our transport operators to provide the transport services you paid for using sufficient knowledge and professionalism. Please note that you are obliged to prove lack of knowledge and professionalism if you wish to file a claim against the company.

9. Complaints
If the service you receive from our partner (supplier) does not meet your expectations, you must immediately notify our customer support service and, if possible, during the incident. You should first contact the local supplier using the number provided in the booking confirmation, and they will assist you in resolving any issues. Their contact details are indicated in the booking confirmation voucher.
Electronic complaints must be sent by email to [email protected] no later than 7 days after your return date.

10. Passenger Conduct
By entering into this agreement, you grant the company and the supplier the right to refuse service to any passenger who, according to the driver's assessment:
• Is under the influence of alcohol or drugs
• Those whose behavior may be deemed dangerous to the driver of the vehicle, third parties, or to themselves.
Alcoholic beverages are not permitted in the supplier's vehicles for consumption during the journey. This prohibition also applies to drugs.
Smoking or eating inside the vehicle is prohibited.

11. Travel Insurance
You are responsible for ensuring that the insurance coverage you purchase meets your specific needs. We strongly recommend that you carefully read the information about your insurance policy and take it with you on vacation.

12. Jurisdiction
These General Terms and Conditions are governed by the applicable laws of Azerbaijan. The contract agreed between you and hertz.org.az shall be governed in accordance with the laws of Azerbaijan. Disputes or claims arising in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Azerbaijan.
If any provision contained in these terms of use is declared illegal, invalid, or unenforceable by a court decision, the remaining provisions shall remain in full force and effect.

13. Privacy
The online privacy policy has been developed to affirm our commitment regarding the information we collect from users on hertz.org.az. This policy covers how easytrip.az provides data for user identification; whether data is collected directly on the website or from other collection means, such as customer support service or phone calls.
